Good morning Port Bureau members,

The Governor of Texas has issued an order that takes effect at noon today requiring that persons arriving by air from New York, New Jersey, Connecticut or New Orleans be quarantined for 14 days. The order expressly provides: “This order to self-quarantine shall not apply to people traveling in connection with military service, emergency response, health response, or critical-infrastructure functions, as may be determined by the Texas Division of Emergency Management.”

TDEM has not adopted the CISA Guidelines on critical infrastructure functions, but they are instead advising that they intend to apply the exemption on a case by case basis to individuals. In other words, every mariner seeking to use this exemption must have separate permission. They have established the following email address to which requests are to be sent: cikr@soc.texas.gov.

TDEM has expressed that they do not wish to exempt industries or companies and instead want to issue a TDEM letter of permission to each individual worker, which that worker must present to the state trooper meeting his or her flight upon arrival, along with proper ID, in order to be exempted from the quarantine order.

So, as things stand now, effective at noon today, mariners coming in to Texas by air from the restricted locations will need a letter from TDEM. This will place a burden on maritime companies and workers, not to mention create an administrative burden on TDEM to process these letters.

Matt Woodruff, Maritime Sector Coordinating Council Chairman, VP of Public & Government Affairs at Kirby, and Port Bureau Director, is sending a request to TDEM and the governor on behalf of the Maritime SCC requesting that they give a blanket exemption to persons listed in MSIB 11-20. He suggests that our members who have contacts in Texas government reach out to them, as well.
